Nigerian Navy Ordered to Reinstate Dismissed Officer, Pay N7 Million in Damages

In a significant legal victory, the National Industrial Court of Nigeria has ordered the Nigerian Navy to reinstate Naval Rating Officer Fagbemi Babatunde, who was wrongfully dismissed in 2008. The court also directed the Navy to pay Babatunde all outstanding salaries, benefits, and pension contributions from August 2008 to March 2025. Additionally, he was awarded N7 million in damages and N1 million for legal costs.

Babatunde’s dismissal was based on allegations of disobedience, specifically for refusing to sign for and collect a weapon while on duty at the Knock Adoon platform belonging to Addax Petroleum Company Ltd. However, he maintained that he was never deployed to that platform and was detained and dismissed without a formal trial. The court’s ruling, delivered by Justice E. D. Subilim, declared Babatunde’s dismissal unlawful, affirming that he was denied due process.

This case highlights the importance of adhering to legal procedures in disciplinary actions within the military. Babatunde expressed relief that justice had finally been served, emphasizing the years of struggle he faced in challenging his dismissal. The ruling not only provides financial compensation but also restores Babatunde’s career and reputation within the Navy.
