NJC Disavows Imo Governor’s Appointment of Acting Chief Judge

In a significant development, the National Judicial Council (NJC) has publicly disassociated itself from the appointment of Justice Theophilus Nnamdi Nzeukwu as the Acting Chief Judge of Imo State by Governor Hope Uzodimma. The NJC clarified that it had not approved this appointment, despite receiving a request from the governor. Justice Nzeukwu, who ranks fourth in the seniority hierarchy of judges in Imo State, was appointed following disciplinary action against the previous Chief Judge.

The NJC’s statement, signed by its Deputy Director of Information, Kemi Ogedengbe, emphasized that Governor Uzodimma had provided reasons for bypassing the three more senior judges, but the Council has yet to deliberate on these grounds. The matter is scheduled for discussion at the next NJC meeting, set for April 29 and 30, 2025. Until then, the NJC maintains that it is not a party to Justice Nzeukwu’s appointment.

This move by the NJC highlights a potential conflict between the state government and the judicial oversight body. While the Imo State Government has defended Justice Nzeukwu’s appointment, citing his seniority based on internal records, the NJC’s stance underscores the importance of its approval in such appointments. The Council’s position is crucial as it ensures adherence to established judicial protocols and maintains the integrity of the judiciary.

The situation also raises questions about the balance of power between state governments and the NJC in judicial appointments. The NJC’s role is pivotal in ensuring that such appointments are made in accordance with established legal and procedural standards, thereby safeguarding the independence and impartiality of the judiciary. As the matter unfolds, it will be closely watched for its implications on judicial governance and the rule of law in Nigeria
