The Osun State Government has reportedly filed a fresh suit at the Supreme Court against the Attorney-General of the Federation (AGF), Lateef Fagbemi (SAN), over the alleged unlawful withholding of statutory allocations meant for the state’s 30 local government councils since March 2025.
According to the report, the new legal action, filed on Monday, follows an earlier withdrawal of a related suit. The originating summons was said to have been filed by the Osun Attorney-General with a legal team led by Mike Ozekhome (SAN) and Musibau Adetunbi (SAN). The state is asking the apex court to compel the Federal Government to release all withheld funds and halt what it described as “an unconstitutional and arbitrary seizure” of local government revenues.
The Osun AG argued that the AGF has disregarded subsisting judgments of the Federal High Court, Osogbo, delivered on November 30, 2022, and the Court of Appeal ruling of June 13, 2025, which affirmed the legitimacy of the council chairmen and councillors elected on February 22, 2025.
However, independent verification shows that while the Federal High Court ruling of November 2022 and the Appeal Court judgment of June 2025 are confirmed and binding, no credible media outlet has yet confirmed the filing of a fresh Supreme Court suit. Senior Advocate Mike Ozekhome did write to the AGF in June demanding enforcement of the Appeal Court’s decision, but the alleged Supreme Court action remains unverified as of press time.
The dispute over control of Osun’s local government councils has remained contentious, with the Federal Government accused of continuing to channel funds to officials backed by the All Progressives Congress (APC) despite court rulings recognizing the February 2025 elected officials from the Peoples Democratic Party (PDP).
